Halle Berry Wins Latest Round in Custody War

According to TMZ.com, a judge ruled in favor of Halle Berry, taking her 2-year-old daughter Nahla to New York where she is filming a movie. The judge disagreed with Gabriel Aubry’s argument that Halle’s work was prohibiting him from co-parenting their child.

As a result, Aubry, withdrew his custody petition in court today.

Sources tell TMZ … Gabriel was trying to block Halle from going to NYC to shoot “New Year’s Eve” — the movie from which she withdrew in order to deal with her custody issues over Nahla.

After hearing arguments this morning from both sides — as Halle looked on — the judge gave her the green light to travel to New York with her kid. We’ve learned she won’t take back the role that was given to Katherine Heigl, but she’ll play another character in the movie.

Halle’s lawyer, Neal Hersh, tells TMZ, “We are pleased the judge took the time to deal with this very imminent and important issue. The judge read a great deal of paperwork and gave us time to argue.”

Hersh added, “Halle is very pleased with the judge’s order.”

  7. It does appear the bastard is trying to get child support :Gabriel Aubry filed a motion yesterday to end his custody case and to dismiss his request for child support from his ex-girlfriend Halle Berry.

    Halle is currently at the courthouse with her legal team, they are in a closed hearing:

    1. Halle, as Nahla’s mother, deserves the utmost respect; and Gabriel, as Nahla’s dad, deserves respect as well. Nahla needs both parents, true, but Gabriel should not be suing Halle for her child and child support. He is just as responsible for providing for Nahla and he needs to get a job to provide for his daughter, instead of trying to get money from Nahla’s mother. I mean, he did model, right; and he can make a living; why is he suing that woman for child support when Halle obviously cares for her own daughter. Get a job, homey and stop the madness.
