Update:”Execution Delayed…Supreme Court To Review”


It will take 5 Supreme Court judges to grant a “stay” in the Troy Davis Case…Stay tuned let’s see what happens.

Despite last-minute interventions by the US Supreme court, a Georgia parole board denied 42-year-old Troy Davis’ petition for clemency.

Davis’ attorneys have pleaded their client’s case to the parole board for years and then for three hours yesterday. Their argument is “Davis would be sent to death under an “enormous cloud of doubt” about his guilt.

Davis was convicted in 1991 of shooting police officer Mark MacPhail to death in Savannah, Georgia in 1989. MacPhail, who was working a second job as a security guard, was shot to death as he went to the aid of a homeless man being attacked by Davis and Sylvester “Redd” Coles in a parking lot.

MacPhail was shot in the heart and face by a black man in a white shirt, according to witnesses. The officer died instantly before he could draw his weapon. Davis was wearing a white shirt that night., however, there is little and/or no evidence to support his guilty verdict.

Earlier that day, Davis was involved in the shooting of another man during a road rage incident. That victim survived his injuries.

On August 19, Coles, went to police and implicated Davis in MacPhail’s killing. That same evening, one of Davis’ sisters drove Davis to Atlanta in an attempt to evade arrest.

Late Monday, Davis’ sister, Martina Correia, said the family was “just praying for a good outcome.”

“He’s guilty,” MacPhail’s widow, Joan MacPhail-Harris, said. “We need to go ahead and execute him.”

Calls for Davis to be spared execution have been made by numerous dignitaries, including former President Jimmy Carter, Pope Benedict XVI, former FBI Director William Sessions, former Georgia Supreme Court Chief Justice Norman Fletcher and Larry Thompson, the former deputy U.S. attorney general. Davis’ advocates, including Amnesty International and the NAACP, have used social media to rally worldwide support. Last week, Davis’ supporters presented the parole board with the names of more than 663,000 people asking that Davis be granted clemency. Their efforts have been to no avail and fallen on deaf ears.

Davis is scheduled to be put to death by lethal injection on Wednesday (tomorrow) at 7 p.m. at the state prison in Jackson.

      1. But Adam… what if, and it maybe a big what if to you, but what if they’re wrong and he dies for something he didn’t do?? He was convicted off witness statements and the word of someone who was committing a crime with him at the time. The witnesses have recanted, the other guy didn’t get the death penalty which means he copped a plea so his “testimony” is automatically suspect or at least it should be, and there is no other evidence tying this man to that crime. If they kill him and he’s innocent, that’s just the blood of one more black man on the state of GA’s hands. I get that cops put their lives on the line, I understand that, but to convict somebody w/o evidence JUST because you want to make someone pay for the death of a cop isn’t right.

        I personally have never had a bad run in with the law. I see many people tell the horror stories of police brutality and I know it exists but there are also good cops out there. It’s never ok to stereotype an entire group based on the actions of a few. Just like blacks don’t like to be steretyped as ghetto, uneducated, and thugs.

The death penalty is abused imo, killing a cop is horrible, yes, but it’s no worse than shooting a person who isn’t in law enforcement so why does one get death and the other get life??? Just asking. It seems to me that there is serious doubt in this case and that right there should cause this to be halted. They don’t have to release him, I don’t think anyone is actually asking for that, just don’t kill the man.

        Basically Coles got to the police first and probably got some sort of deal for ratting out Davis.

    I don’t know this story well enough to determine his guilt but I watch a lot of shows like First 48 and I don’t think a heartless killer should be clothed, fed and housed on tax payers dime. Likely including the family you destroyed.

  22. I thought that there could not be a inch of doubt in a capital punishment sentence. Didn’t several witnesses come forward with different stories . I also saw that one of the jurors in the original case was outside protesting on the side of Mr. Davis.

How do we not know he did not “flee” with his sister because of the man he allegedly shot earlier as opposed to the police officer? I for one know when its a high profile case the pressure is on to find and convict someone. We all know there have been cases later proven where innocent men have either been jailed or put to death for crimes they did not commit.     That is a rumor about Troy shooting somebody else that night in addition to the cop. There is way to much doubt in this case. Him running doesn’t mean he is guilty just scared as he should have been look at him now he knew he was going up the river w/o a paddle regardless.

    I have always felt there are way more innocent ppl in prison than the gen public wants to admit sadly.

Casey Anthony got a slap on the wrist for killing her kid, but people have recanted thier stories with Troy leaving reasonable doubt and he gets juiced… GA cops are known for skewing the facts in cases. They use threatening tactics to get you to say what they want you to hear.

  33. The officers son was on the news Monday. He wants to be there when Davis is executed. He was a newborn when his father was killed. I know this kid wants justice for his dad, but I don’t see it any other way but predjudice that the kid would want Davis to die knowing 7 ppl have recanted their story, along w/no physical evidence. The family can stop an excution. This kid is going to have to live w/this for the rest of his life,(if Davis is executed) if they later find evidence, or someone steps up and admits guilt.       troy davis couldn’t afford an attorney therefore he was provided local prosecutors who couldn’t afford to research his case or his innocense. this is justice denied which is an injustice everywhere! Read everything about this case and STOP responding half assed!

        Whether you think its right or wrong if all these witnesses have recanted there is something to that. Point. Blank. Period. Witnesses don’t recant unless there is a reason to. Period. So either way it goes I do not believe this is being seen fairly. People are so quick to jump on bandwagons regardless to what may or may not be going on. People are still being released from death row, or being proven after the fact as being innocent. When there is so much doubt how is it ok to still put someone to death?

  37. This is so sad! This man should not be put to death. And the family of the victim just want to see a black man be put to death.They don’t care about guilt or innocence. As someone else stated, the son of the victim was a infant when his father was killed, but he is certain that Davis is guilty and should be killed. The mother has gotten her 15 minutes as well. She has been on the news more than a little bit in the last week. I didn’t see her this much the last time the Supreme Court stayed his execution…and yes I was following the story then to. She claims she doesn’t want vengence in Davis’ death, just justice. How can there be justice when there is still doubt? She’s a lying cow. Im sorry. I dont care if she is positive about his guilt, her intentions are not pure and I can see through her. She wants blood. If Mr. Davis would have been a white man, I guarantee she and the rest of her family wouldn’t be rallying so hard for this man’s death.

    This is justice in America. Why not give him life without the possiblity of parole? Why cant the family find closure in that? A white Texas man, cleve foster, who raped and killed a woman was saved by the U.S. Supreme court not to long ago. Why is Troy Davis being killed and there is still some doubt? He will probably be killed this evening, and things will continue to be F-d up in the justice system. And people (especially blacks) who are all for him getting killed will stay on the band wagon until something like this unfairly happens to their family member.       Fact is, our justice system says, guilty beyond a reasonable doubt. Casey Anthony….most of us think she did it, but fact is, there was reasonable doubt. In this case….to take a line from casey anthony’s attorney, “reasonable doubt lives here”. I don’t know if he’s innocent or not…i rather say I don’t know…..

      We don’t have the death penalty here in nyc, but just in our paper yesterday was article about a man, doing life llikely for a murder he didn’t commit. There is ample evidence that shows that he was even in the car, all the witness who implicated him in the car said the prosecutor pressured them into sayin he was the shooter, one even said that in his original statement to police, he told them, the guy was even in the car, the officers didn’t file that away. would god let a innocent man sit in prison for crimes they didn’t do? Happens all the time.

        1) Seven of the nine “eyewitnesses” recanted their stories. One of the two who didn’t was the principle alternative suspect in the crime.

        2) No physical evidence was ever found (no, DNA, no murder weapon, etc.)

        So there’s no cause for an execution.
